In a developing controversy, Republican lawmakers and former Trump administration officials have raised concerns over the alleged misuse of the presidential autopen during President Joe Biden’s tenure.
The autopen, a device traditionally used for signing non-urgent documents, is now at the center of a debate regarding the authenticity and legality of several executive actions taken in the final months of Biden’s presidency.
Allegations of Autopen Misuse
David Sacks, a former artificial intelligence advisor under President Donald Trump, claimed in a recent interview that Senator Elizabeth Warren (D-MA) had significant influence over the use of the autopen in the Biden White House.
Sacks alleged that Warren’s “pathological hatred of the crypto community” motivated her to control the autopen’s application, particularly concerning executive orders affecting cryptocurrency regulations.
“Elizabeth Warren controlled the autopen during that administration,” Sacks stated, suggesting that her involvement aimed to “drive this community offshore.”
Controversial Pardons and Executive Orders
The controversy intensified following reports that some of President Biden’s final acts in office, including pardons granted to members of the January 6 select committee, were signed using the autopen. Former President Trump has challenged the validity of these pardons, arguing that they may have been executed without Biden’s direct knowledge or involvement.
“Crooked Joe Biden got us into a real mess with Russia and everything else he did, frankly. But he didn’t know about it and he, generally speaking, signed it with autopen, so how would he know that autopen is a big deal,” Trump remarked during a speech at the Department of Justice.

Trump further criticized the use of the autopen, stating, “Number one – it’s disrespectful to the office. Number two – maybe it’s not even valid because who’s getting him to sign? He had no idea what the hell he was doing.”
Investigations Underway
The Oversight Project, affiliated with the conservative Heritage Foundation, has initiated a comprehensive review of documents bearing President Biden’s signature. Their preliminary findings suggest a consistent use of the autopen, with the exception of the announcement regarding Biden’s withdrawal from the presidential race.
“WHOEVER CONTROLLED THE AUTOPEN CONTROLLED THE PRESIDENCY,” the group asserted on social media, emphasizing the potential implications of their findings.
House Oversight Chair James Comer (R-KY) has also taken action, sending requests for testimony to numerous former Biden staffers and confidants. Comer warned that subpoenas could be issued should these individuals fail to comply within a week.
Additionally, Ed Martin, the incoming pardon attorney at the Department of Justice and head of the DOJ’s Weaponization Working Group, confirmed an ongoing investigation into the autopen’s use for Biden’s last-minute controversial pardons.
Martin revealed that the probe has been active for some time, with several individuals retaining legal counsel and a whistleblower coming forward with serious allegations.
